The Public Defenders, as an institution in the Brazilian legal system, was only recognized as an essential part of justice, at national level, with the Federal Constitution of 1988. An important organ to provide the population not only access to the judiciary, but also, and especially, to provide access for the average citizen to Justice and Fair Legal Order, serving as a true rights educational tool and defend the most vulnerable groups in Brazilian society, still with great social inequity, and which, in fact, historically always had groups of people at risk and lacking even knowledge of their rights and information on how the Brazilian State should treat the impoverished citizens in the face of an everyday life full extraordinary difficulties. Constitutional Amendment nº 80/2014 consolidates the Public Defenders Institution (Ombudsman) as a true guarantor of minimum rights to those in need (an instrument of the democratic regime for vulnerable groups), placing it at the same level, as it should always have been, of the Accuser State (Public Ministry ) and State Judge (Magistrates), providing balance of weapons and power between all the major institutes related to the essential functions of justice.
