The aim of this research is to establish criteria for application to the institute of objective civil liability in labor law, brought by the civilian legislator in Article 927, sole paragraph of the Civil Code, cases in which the offender must repair damages regardless of fault. For the application of the institute the legislator opted for open concept standards, which should be applied to the concrete case from a subjective interpretation of the operators of the law. With this, we seek measures to integrate the civilian measure with the work order, where civil liability is applied based on the analysis of the activity of the employer. This fact is of paramount importance to the legal system, due to the high accident rates in our country, and the jurisdictional difficulty of the offended person in proving the fault of the aggressor and the consequent repair. Finally, more specifically in the final chapter, we deal with the exclusions of unlawfulness of objective liability – those that break the causal link between the risk activity and the accident suffered – at which time it is proven that the obligation to indemnify the employer is not removed
