Resumo: We live in a time of great concern for the environment. There are several problems from pollution and irrational use of natural resources caused by man. Since this is a fundamental right and essential to a healthy quality of life, environmental protection must be safeguarded by various branches of law, including tax law. This paper aims to analyze how tax law by extrafiscal function of taxes, can serve as an effective tool for the sake of protecting the environment while observing the limits constitutionally imposed on the power to tax. Considering that Brazil is a Democratic State Fiscal and, starting from an analysis of constitutional provisions, it is clear for compliance in the use of inducing tax rules under any of the tax species in pursuit of sustainable development

Diversos são os problemas decorrentes da poluição e do uso irracional dos recursos naturais causados pelo homem. Tratando-se de um direito fundamental e essencial à sadia qualidade de vida, a proteção ambiental deve ser tutelada pelos mais variados ramos do direito, inclusive pelo Direito Tributário. O presente trabalho tem como objetivo analisar como Direito Tributário através da função extrafiscal dos tributos pode servir de instrumento eficaz em prol da proteção do meio ambiente sem deixar de observar os limites constitucionalmente impostos ao poder de tributar.
