O desenvolvimento na constituição da República Federativa do Brasil de 1988: um direito fundamental ou objetivo da república?

Resumo: The development is essential to the process of emancipation of individuals facing the realization of their fundamental rights (whether individual or collective), however, in spite of the various constitutional provisions about the issue of development, much still discusses the normative or juridical these constitutional provisions and its coverage nationwide. Whereas Development and Constitution are words that carry strong ideological load, this study aims to indicate the design and axiological relevance of development expression to the constitutional dogmatic and the analysis of the existence (or not) the fundamental right to development, particularly in the domestic sphere. Literature searches and some updates taken from the Internet have allowed us to conclude that the Right to Development is peacefully recognized internationally as a right of man, but still needs some interpretative effort for its acceptance in the Brazilian constitutional law

No entanto, em que pesem as várias disposições constitucionais acerca do tema do desenvolvimento, muito ainda se discute sobre a normatividade ou caráter jurídico dessas previsões constitucionais e a sua abrangência em âmbito nacional. Considerando que desenvolvimento e Constituição são palavras que carregam forte carga ideológica, o presente estudo busca a indicação da concepção e da relevância axiológica da expressão desenvolvimento para a dogmática constitucional e a análise da existência (ou não) do direito fundamental ao desenvolvimento, principalmente em âmbito doméstico.
