This dissertation aims to identify and describe the relevance and appropriateness of the scope assigned to the Accusatorial Criminal Justice System in the light of the Democratic State‘s paradigm. Currently, the Criminal Process is characterized by the (effective) participation of the subjects in the construction of the jurisdictional provision (verdict) and works as an instrument limiting the State‘s interference in the individual‘s freedom. Aiming the preservation and effectiveness of such constitutional guarantees, it is pursued the exposure and the overcoming of the inquisitorial culture yet so present in the mentality of the Brazilian criminal procedure, which ends up generating judicial monologues. As a result, it is necessary to point out the characteristics of each system‘s concept (inquisitorial, accusatory and mixed), declining, at the end of this part, the model that is exactly compatible with the constitution of the Federative Republic of Brazil from 1988. In addition to that, the present work adopts the concept of a process (contradictory procedure) defended by Elio Fazzalari, in order to allow the parties to have a direct influence on the construction of the judicial decision, thus conferring on it the greatness of legitimacy. Finally, there is a description of the compatible scope(s) with the Democratic Criminal Procedure
