This paper aims to analyze the legal nature of the judicial decision which anticipates the effects of the request, when part of that seems to be uncontroversial. The study is justified by the fact that, with the recent reforms of the Brazilian Civil Procedure Code, the lawmaker expressed concern with the celerity and effectiveness of the court provision, benefiting that one who seeks the Judiciary to enforce their right. However, despite the contemporary thought of these reforms, tradicional thoughts still have strength in the Brazilian Legal, presenting arguments that make the jurists afraid to apply the technique mentioned above. To achieve its objectives, firstly, the judicial pronouncements were classified. Posteriorly, the anticipated judicial protection was conceptualized. In the next chapter, the legal nature of the decision that anticipates the effects of protection on the undisputed demand was addressed, as well as relevant aspects of the topic. Finally, the innovations that will be brought by the new Brazilian Civil Procedure Code were discoursed
