The purpose of the present work is to study the applicability of the Theory of Objective Imputation in cases related to Civil Liability for Damages to the Environment. The study is justified to the extent that the doctrine and jurisprudence have been adopting increasingly a posture hyper-protectionist that, many times, in addition to extrapolate the good legal technique, ultimately perpetuate injustice and establish insecurity for participating agents involved, directly or indirectly, in events potentially pollutants. Thus, in the face of patent unbridled development theme in the Courts, as well as in Doctrine, it was felt by well to propose a theory of counterweight to start the creation of limits and barriers for the relativization of legal institutions. For both, starting on the study of Environmental Liability and their respective elements, the study focus on the analysis of the causal connection, as well as the current relativization perpetuated by the Courts and Doctrine for, in the final analysis, criticizing them, propose the use of the Theory of Objective Imputation as an additional parameter in the analysis and valuation of the causal element necessary for the allocation of Civil Liability
