Pets are classified by Article 82 of the Civil Code as ‘movable property’. However, the dynamics of family relationships have brought a new need to the Judiciary: to appreciate the cases in which couples unite and nurture affection for domestic pets and, when they separate, do not conform to the division of these animals as "things" to be shared. In this step, it must be demonstrated that the history of families in Brazil indicates gradual evolution and broadening of the concept, and there are currently numerous forms of family entities, all recognized and taken over by state protection. Added to this is the advent of the Federal Constitution of 1988 as a determining landmark for the new legal order, having inserted a new collective right consistent in the balanced environment and the prohibition of cruel treatment to animals, which, added to the Affectivity Principle , requires the insertion of the multispecies family as a constitutionally protected legal good and the need to point out solutions so that the bonds of affection are properly valued, respecting the normative limitations that exist in Brazil
