This paper aims the analysis of the issues of greatest importance and subject of discussions involving the jurisdictional control of public policies. Initially, it examines the historical evolution of the Separation of Powers, as well as the contemporary state of crisis that has led to Judicialization of Policies. It then passes to the study of public policies and parameters that should guide their enforcement by the Courts. Finally, an approach is made about the balance of interests between the Reserve of Possible (available resources)and Minimum Existential, concluding with the precedents of the Supreme Court on the matter
