The present work of monograph, entitled ―The Anticipation of the Effects of the Specific Guardianship for the Protection of the Rights of the Author‖ deals with necessity to grant a temporary restraining order to the obligation of doing or not doing with the purpose of removal and prevention an unlawful act performed by an infringer through the unauthorized use of an intellectual work. In order to give a better comprehension of the subject matter of the monograph, first of all, it is presented a brief explanation of the institute of the rights of the author (copyright), discoursing about its dualistic conception, that is, in the rights of the author coexist separately (but independently), moral rights and patrimonial (exploitation) rights, but derivatives of a unique source: the intellectual work. Afterwards, it is explained the institute of the specific guardianship, and the necessity to anticipate its legal effects because the unauthorized use of an intellectual work will cause damages difficult to be recovered to the authorship, who could not wait the long and unavoidable delay of a final judgement, with the risk of the lack of efficacy of the jurisdictional service rendered when the judgement would be pronounced
