Resumo: This thesis presents an approach about the possibility of partial dissolution of the company by capital stock closed due to the disruption of societatis affectio. Depending will be shown, both the doctrine and the case law has adopted the understanding that it is fully possible some partial dissolution of some joint-stock capital closed for breach of societatis affectio, such as the said company as a family. Understanding is signed on the grounds that although cited society is eminently capital, that has personal intuition character, considering that at the time of its formation is taken into account not only capital but also trust, harmony and the mutual respect between shareholders

Consoante será demonstrado, tanto a doutrina quanto a jurisprudência vem adotando o entendimento de que é plenamente possível algumas dissolução parcial de algumas sociedade por ações de capital fechado por quebra da affectio societatis, como por exemplo a sociedades ditas como familiar.
