Resumo: This paper discusses immunity on ITBI - Tax on Transfer of Real Estate charged on the acquisition of vacant or unbuilt real state by an educational non-profit organization. This theme is a recurring issue before the Courts and its relevance is connected to the divergence of interpretation between the Municipalities (Active subject) and the non-profit educational institutions (Passive subject), in recognition of the requirements that allow immunity on ITBI charged on the acquisition of vacant or unbuilt real state and the presumption of the existence of these requirements at the time of acquisition. The arguments currently used by specialists and Court decisions to recognize the immunity of ITBI will be comparatively analyzed within the limits of the theme
