This study aims to analyze the sexual harassment occurred within the work environment, which is very relevant issue today, both for the case law to practice in the day-to-day lawyers, militating from the preparation of the application, through the various types of hearings, the appellate stage and especially at the implementation stage, this time it is finally paid the arbitrated value of moral, value without specific size is stipulated according to the narrated and proven case. Sexual harassment in the workplace is much discussed in the courts and doctrines in many ways, practically impossible to determine the size of each harassment by the harasser, because each case is different. The technique applied in the preparation of the monograph was deductive, building in a logical structure, the proposals to achieve the result; the procedure was the comparison, to establish parameters parallel to the subject and the study was based on the compilation of doctrine and jurisprudence. So far, the result may well involve in the courts decide, in order to pacify the case law, however, it would be legally more weighted the legislature to create a device that would put an end to this controversy, satisfying all parties involved the employment contract, and, why not say, the right operators, which would more an instrument in the search for the realization of justice
