Resumo: The present work will explore the theme related to conflicting principles regarding the prohibition of the dissemination of fake news and misinformation, considering the impacts that this measure has on the components of the right to information. Thus, the conception of legal principles will be analyzed, as well as their potential for restriction within the factual context in which they are embedded. The principle of balancing or proportionality will also be explored, exposing the weight formula, essential for resolving conflicts of principles, as they have a relative nature and can be restricted depending on the factual situation in which they are placed. Subsequently, the concepts of information, the right to information, fake news, and misinformation will be explained, and how these topics relate to each other will be demonstrated. It will be shown that a normative determination prohibiting the dissemination of fake news and misinformation represents, at the same time, the realization of the right to be informed and the restriction of the right to inform regarding the freedom to disseminate information that individuals deem relevant. Finally, a weighing of conflicting principles will be carried out in the presented factual context, using the principle of proportionality through the weight formula. The conclusion will be that the measure to prohibit the circulation of fake news and misinformation is legally justifiable and valid, as the right to be informed has greater relevance in this case compared to the right to inform, concerning the freedom to disseminate information

Desse modo, analisar-se-á concepção de princípios jurídicos, bem como sua possibilidade de restrição dentro do contexto fático em que eles estejam inseridos, bem como será explorado o princípio da ponderação ou da proporcionalidade, expondo a fórmula do peso, essencial para a solução de conflito de princípios, uma vez que estes possuem caráter relativo, podendo ser restringidos diante da situação fática que se inserem. Doravante, serão expostos os conceitos de informação, direito à informação, fake news e desinformação, e como esses temas se relacionam entre si, demonstrando que uma determinação normativa que vede a veiculação fake news e desinformação representa, ao mesmo tempo, a concretização do direito de se informar e a restrição ao direito de informar no que se refere à liberdade de veicular informações que o indivíduo julgue pertinentes.
