This paper aims at the study with consequent reflections on the compatibility between the figure of the employee exercising the position of trust under the terms of article 62, item II of the Consolidation of Labor Laws and the full enjoyment of the right to leisure, passing through historical and evolutionary analysis Both of the limitation of the journey as a whole, as well as the managers and the assimilated and their requirements of characterization. Seeking reflection on the practical conformity between the position of trust with an unlimited working day combined with the technological advances, that surpass practically all the barriers imposed and known, and all their duties and obligations inherent to the position of senior executive and the right to the Leisure as a fundamental social right to the dignity of the human person, bringing brief notes on the difficulties imposed and existing for the full satisfaction of this right by the category in focus
