Resumo: This study aims to analyze the applicability of the institute of civil liability in cases of abandonment of adoption during the stage of cohabitation, during the provisional custody and after the transit in res judicata of the sentence of the adoption lawsuit. In order to proceed with this study, the principles that guide the family law were analyzed, as well as the evolution of the family institute in the Brazilian legal system, what the law states about the rights of the adopted child and what are the duties of the adopters in such relationship, as well as the stages of the adoption process, currently foreseen in the Child and Adolescent Statute. In order to evaluate the possibility of the application of the institute of civil responsibility in cases of abandonment of the adoption, the elements that cause the duty to indemnify present in the Civil Code were analyzed, as well as the jurisprudential research in several courts in the country

Para a realização do presente estudo foram analisados os princípios que regem o direito de família, a evolução do instituto família no ordenamento jurídico brasileiro, o que versa a lei sobre os direitos da criança adotada e quais os deveres dos adotantes na referida relação, bem como foram estudas as etapas do processo de adoção, previstas atualmente no Estatuto da Criança e do Adolescente.
