The athlete professional employment contract is signed between a professional athlete player and a professional entity. The draft of the contract must obey the specific law of the professional athlete player, Lei Pelé n. 9.615 / 98 in certain aspects, such as duration, form and even penalties in case of termination, among other peculiarities, such as life insurance and personal accidents that are specific for this type of contract. The thesis discussed herein was elaborated based on qualitative research, considering that the athlete professional employment contract is not commonly portrayed both in doctrines and in jurisprudence. Based on books of general labor law, employment law and athlete law, and as well as a selected jurisprudential research on the subtopics that cover the athlete professional employment contract, it was possible to delimit the essential clauses that must be drafted on that special contract. However, taking into account the analysis of the contractual clauses in the athlete professional employment contract, it was possible to verify the existence of legal gaps that need a jurisprudential pacification so that the subject and subtopics of this type of contract doesn’t require to be frequently debated in our Labor Courtsas per different understanding of the specialized jurists who is leading the career of the athlete professional or the athlete professional entity
