This work aims to focus on the relationship between retirement and guaranteed compensation of 40% of deposits in the National Insurance (FGTS), upon dismissal. In order to do so, we'll quickly present the historical evolution of FGTS, its concepts and its legal status, ending the first chapter with a comparison between the labor pensions we have here in Brazil and the foreign labour guarantees. Beforegoing straight to the main point of the work, we will briefly introduce the concepts of the types of retirement in order to enable the consideration of the right to apply 40% of the fund in case of redundancy. An analysis of the law number, 8.036/90 becomes extremely important, since it is the law that precisely treats about the fund. After going through all these points, we reach the main issue of this work. Although it has already been discussed in the doctrine and jurisprudence and ratified by the position taken by the Supreme Court, which cleared the Jurisprudential Orientation of Section 177 of the Superior Labour Court (TST SDI-I), the jurisprudence is still divergent on certain situations. This work ends with a compendium of jurisprudence showing, that despite, the Jurisprudential Guideline Section of Individual Issues (SDI-I/TST) of the Superior Labor Court 361, which recognizes that retirement does not extinguish the employment contract, there is still some disagreement in our courts regarding the legal reflexes of this act in the incidence of 40% FGTS fine, but the matter seems to move towards a solution
