In the last couple of years, the criminal immunity deal has played a major role in the Brazilian scenery, especially with the outbreak of operation “Lavajato” by the Brazilian Federal Police. Since then, the diverse innovations brought on by the arrival of the law nº 12.850/13 have risen theoretical and practical issues that, in order to be correctly answered, demand a deeper knowledge of the context in which the criminal immunity deal was introduced in Brazil and the characteristics of the institute. Therefore, this term paper proposes to analyze the diverse aspects of the criminal immunity deal in the light of the new legislation. By means of a retrospective of foreign experiences in this kinds of deals, the context in which the mechanism arose in Brazil as well as the laws that tend to the criminal immunity deal, in contrast with the ongoing regulation the singularities of the institute in the Brazilian legal system are indicated. In the end, a brief analysis of the current position of the Brazilian Supreme Court concerning the “plea bargain”
