Resumo: This monograph is based on bibliographical, legislative and jurisprudential research and aims to identify the existing limits of labor collective bargaining, especially those imposed by the State regulation, as well as the application of collective clauses, content of the collective labor instruments (Collective Labor Convention and Collective Bargaining Agreement) in individual employment contracts. It briefly analyzes the current Brazilian trade union model (union unicity) and its effects on union activity, detecting the possibility of union representatives' lack of representation in the negotiation process. Besides the legitimacy to negotiate, considering collective private autonomy, it also verifies important functions of collective bargaining, its comprehensiveness and the instrumentalization of solutions for collective conflicts. In addition, it examines the ways of solving conflicts between labor regulations, including collective ones, and the possibility of flexibilization of labor rights (clause in pejus) in collective labor instruments. Finally, it presents non-exhaustive considerations on the changes arising from Law 13467 of July 13, 2017

Finally, it presents non-exhaustive considerations on the changes arising from Law 13467 of July 13, 2017Esta monografia, a partir de pesquisa bibliográfica, legislativa e jurisprudencial, procura identificar os limites da negociação coletiva do trabalho existentes, especialmente os impostos pela norma heterônoma estatal, e da aplicação das cláusulas coletivas, conteúdo dos instrumentos coletivos de trabalho (Convenção Coletiva de Trabalho e Acordo Coletivo de Trabalho), nos contratos individuais de trabalho. Realiza breve análise do modelo sindical Brasileiro atual (unicidade sindical) e seus reflexos na atuação sindical, detectando a possibilidade da falta de representatividade dos entes sindicais no processo negocial. Além da legitimidade para negociar, considerando a autonomia privada coletiva, verifica também importantes funções da negociação coletiva, a sua abrangência e a instrumentalização das soluções dos conflitos coletivos. Ademais, examina as formas de solução de conflitos entre normas trabalhistas, dentre elas as coletivas, e a possibilidade da flexibilização de direitos trabalhistas (cláusula in pejus) nos diplomas negociais.
