Soberania e intervenção estrangeira: análise jurídica da crise na República Bolivaria Venezuela

Resumo: This dissertation presents considerations about ideas and concepts that are directly linked to contemporary debates and conflicts in the scope of international law, human rights and international relations. As the main focus of this research, it is expected to understand how the concept of sovereignty evolved to the extent that it allowed the formation of more efficient political organizations. Currently, with the advance of globalization, there is a great interaction among the nations and a significant increase in the interdependence of these state actors in strategic areas such as trade, investments, movement of persons, the fight against organized crime and the maintenance of public order. In order to link these ideas to a practical and current issue, the political-constitutional crisis faced by the Bolivarian Republic of Venezuela is analyzed, mainly from the year of 1999 to the first half of 2020. Tensions in this country have generated considerable movement by nations and groups interested in the Venezuelan crisis management and resolution. This context reveals another subject that is addressed in this dissertation: the interference and intervention of foreign groups in the internal affairs of nations in situation of social instability, political debility and economic insufficiency. Thus, based on the review of the concepts of sovereignty and the use of force in international law, an attempt is made to answer whether humanitarian intervention by the international community in Venezuelan issues is appropriate and necessary. As for the methodology adopted for the preparation of this dissertation, the deductive approach method is chosen. The procedure method consists of a combination of historical, monographic and statistical methods. Finally, the research technique consists of bibliographic analysis and case study by means of the reading of articles, the compilation of significant reports and field research

Como foco central deste trabalho de pesquisa, busca-se compreender de que maneira o conceito de soberania evoluiu na medida em que permitiu a formação de organizações políticas mais eficientes. Atualmente, com o avanço da globalização, verifica-se uma grande interação entre as nações e um expressivo aumento na interdependência destes atores estatais em áreas estratégicas como as do comércio, dos investimentos, da circulação de pessoas, do combate ao crime organizado e da manutenção da ordem pública. Com o objetivo de vincular tais ideias à uma questão prática e atual, trata-se da crise político-constitucional enfrentada pela República Bolivariana da Venezuela, sobretudo desde o ano de 1999 até o primeiro semestre de 2020. As tensões neste país têm gerado considerável movimentação de nações e grupos interessados na condução e na resolução da crise venezuelana. Tal contexto revela mais um ponto tratado nesta dissertação: a interferência e a intervenção de grupos estrangeiros em assuntos internos de nações em situação de instabilidade social, de fragilidade política e de insuficiência econômica. Desse modo, a partir da avaliação dos conceitos de soberania e do uso da força no direito internacional, busca-se responder se é cabível e necessária a intervenção humanitária, por parte da comunidade internacional, nas questões venezuelanas. Quanto à metodologia adotada para a elaboração desta dissertação, opta-se pelo método de abordagem dedutivo. Já o método de procedimento consiste na combinação dos métodos histórico, monográfico e estatístico.
