Resumo: The present work tackles the Theory of the Judicial Precedents, pointing out its incidence in the labor-legal scope and the formation possibility of a mixed legal system of the Brazilian Roman-German Law. The research begins from the differentiation of the legal systems of Civil Law and Common Law. After that, we have the concept and application and overcome technics of the judicial precedents: the distinguishing and the overruling. And from that on, it is presented the usage of such judicial precedents in the process labor law through the application of the Theory of the “Dialogue des Sources”. It is also observed the reforms that the Process Civil Code has suffered and made brief comments about the changes brought about by the law 13.015/2014.To sum up, before such reality, it is aimed, throughout the present paper, at developing a study demonstrating the importance of the judicial precedents to the guarantee of the legal certainty

Inicia-se a pesquisa pela diferenciação dos sistemas jurídicos de Civil Law e Common Law. Após, conceito e técnicas de aplicação e superação dos precedentes judiciais, o distinguishing e o overruling. E a partir disso, apresenta-se a utilização dos precedentes judiciais no direito processual do trabalho através da aplicação da Teoria do Diálogo das Fontes. Observando também as reformas sofridas pelo Código de Processo Civil, bem como tecendo breves comentários sobre as mudanças promovidas pela lei 13.015/2014.
