Resumo: The present work has the purpose to discuss the liability of the physician in cases of iatrogenic purely in aesthetic plastic surgery , in view of the extreme importance of the topic in the legal framework . Daily numerous people undergoing medical surgeries for repair some damage occurring to your health , or even for simple cosmetic repair and consequent physical improvement . That occurs among these procedures may arise unexpected reactions by health professionals in the body of his patient . These unexpected reactions that are didactically called iatrogenic , each organism to be unique , will present different forms of reaction to common procedures and equipped with all the necessary caution , it is impossible to predict the health professional such cases . So the doctor should be held accountable for any damages arising out of these unexpected reactions ? With respect to purely aesthetic plastic surgery , there is the accountability of the medical professional ? That said , we will just discuss the comments of the doctrine regarding this topic as well as the analysis of case law , seeking to verify the prevailing understanding of our magistrates regarding the question raised

Diariamente inúmeras pessoas submetem-se a cirurgias médicas, para que sejam reparados alguns danos ocorridos à sua saúde, ou mesmo para a simples reparação estética e consequente aperfeiçoamento físico. Ocorre que dentre estes procedimentos podem surgir reações inesperadas pelo profissional da saúde no organismo de seu paciente. São estas reações inesperadas que didaticamente chamamos de iatrogenia, sendo que cada organismo, por ser único, apresentará diferentes formas de reação a procedimentos comuns e dotados de toda a cautela necessária, sendo impossível para o profissional da saúde prever tais casos. Deverá assim o médico ser responsabilizado por eventuais danos que surgirem destas reações inesperadas? Com relação a cirurgias plásticas meramente estéticas, há a responsabilização do profissional da medicina?
