This work studies the historical evolution of burden of proof in the labor process, it also examines the concept of burden of proof and the basic principles that guarantee the equal treatment, impartiality and transparency to the parties and judge in the labor process. Furthermore, this study has the specific objective of verifying the burden of proof in its general aspects, analyzing the theoretical evolution and dogmatic profile of the reversal of the burden of proof and its acceptance and the procedural moment suitable to the reversal of the burden of proof. It analyzes general aspects concerning the theory of dynamic distribution of the burden of proof, establishing concepts and distinctions between static distribution and dynamic distribution of the burden of proof. Finally, this research concludes for the application the reverse burden of proof at instruction hearings, always respecting all the principles applied on the labor process and in theory of dynamic distribution of the burden of proof to ensure more effectiveness in the procedural progress and adjudication in the labor process
