Resumo: The work is presented by the the student Adriana Freitas Chahine, to labor law postgraduate course towards Pontifícia Universidade Católica de São Paulo, by the title “The Employees Credits on Bankruptcy Plans”. Te work focused on the examination of the labor credit in bankruptcy plans of companies in crisis, created by Law 11,101 of 09 February 2005 and the effects of this law in labor agreement. It uses the deductive method, with doctrinal research, analyzes the labor credit, its nature and its protections in the preparation, negotiation and execution of the reorganization plan. It is divided into four chapters that discuss: companies under Brasilian law; some crisis overcoming methods; a summed up view of statutory bankruptcy plans; and some applicable topics of employees creditors on the statutory bankruptcy plans. It is also aboute some legal limits of companies reorganization plans, analyzing deadlines of payments in labor credits and some recovery methods that can be used in the reorganization plans. It also analyzes the employers succession doctrine in compliance to the most important judgment from the Superior Court in Brasil

O trabalho tem como tema o exame do crédito trabalhista nos planos de recuperação judicial das empresas em crise, com base na Lei 11.101, de 09 de fevereiro de 2005 e os efeitos dessa lei nos contratos de trabalho. Utilizando método dedutivo, através de pesquisa doutrinária, analisa o crédito trabalhista, sua natureza e suas proteções na elaboração, negociação e execução do plano de recuperação judicial de empresas. É dividido em quatro Capítulos que abordam: empresa no direito Brasileiro; meios de superação da crise das empresas; síntese do procedimento da recuperação de empresas; e questões relevantes quanto aos credores trabalhistas na recuperação judicial de empresas. Estuda os limites que o Direito do Trabalho impõe ao plano de recuperação judicial, analisando prazos para pagamentos dos créditos trabalhistas e alguns meios de recuperação que podem ser utilizados nos planos.
