Resumo: | This monograph aims to demonstrate to the reader the applicability of so-called atypical enforcement measures as a means of guaranteeing effectiveness in the enforcement phase of civil proceedings. To this end, it presents an overview of Brazilian civil procedure, with the presentation: of the procedures commonly carried out in the knowledge and execution phases of the civil process; the crisis of effectiveness that allows Brazilian civil execution; executive measures adopted during the execution phase, typical and atypical; to then discuss some important guidelines to be observed when adopting atypical executive measures. Finally, this work analyzes the rulings previously established so far by the main Brazilian Superior Courts in relation to the application of the procedural instruments in question. The monograph is justified by the existing controversy regarding the constitutionality of the application of atypical measures in actions aimed at pecuniary benefits. This is a qualitative, basic, descriptive study, which used bibliographical research and case studies for its realization. In conclusion, the results obtained were favorable to the application of atypical measures in Brazilian civil procedure, as long as fundamental guidelines are respected, as will be shown below |

Para tanto, apresenta um panorama geral do processo civil brasileiro, com a apresentação: dos procedimentos comumente realizados nas fases de conhecimento e execução do processo civil; da crise de efetividade que permeia a execução civil brasileira; das medidas executivas adotadas durante a fase de execução, típicas e atípicas; para então discutir algumas diretrizes importantes de serem observadas para a adoção das medidas executivas atípicas. Por fim, o presente trabalho analisa os ditames até então estabelecidas pelas principais Cortes Superiores brasileiras em relação à aplicação dos instrumentos processuais em comento. A monografia justifica-se pela controvérsia existente acerca da constitucionalidade na aplicação das medidas atípicas nas ações que tenham por objeto prestação pecuniária. Trata-se de pesquisa qualitativa, de natureza básica, descritiva, em que se utilizou de pesquisa bibliográfica e de estudo de casos para sua concretização.
