The use of electronic devices in the workplace has become essential in the routine of the organizations, assisting in the dynamics of the activities and fostering the modernization in the communications. Nevertheless, the employer’s directive power allows the company to define the way in which such devices will be used by its employees, as well as allows the work environment to be monitored and supervised. Such power, however, is not absolute, often bumping into the employee's right to intimacy and privacy, attributes inherent to the personality rights of the worker as a human being. The objective of this study is to analyze the confrontation between the directive power of the employer and the employee's right to privacy in relation to the electronic devices currently used in the workplace. In order to solve this conflict, the main characteristics of these rights in collision are presented in this work, so that, through the analysis of the legal order and the balance of interests and values, as well as of the jurisprudential and doctrinal understanding, the conclusion on which of these precepts should prevail depending on the specific case is reached
