Resumo: This work analyzes the national legal protection of Access and Benefits Sharing based on the internalization in the Brazilian legal system of the Convention on Biological Diversity, the Nagoya Protocol and the Aichi Biodiversity Targets, in addition to covering the creation of the Brazilian Biodiversity Law, which modernized the regulation on access to Genetic Heritage and Associated Traditional Knowledge and on the Benefit Sharing obligations linked to these accesses. Some of the main challenges related to the topic are brought up: biocultural colonialism, biopiracy, the need for greater international cooperation to guarantee respect for holders of traditional knowledge and underdeveloped countries, and the need for a multidisciplinary approach to the subject. This is a complex and extremely relevant topic for Brazil, a country with the greatest biodiversity in the world, which can benefit from Benefit Sharing, which has the potential to contribute to its sustainable development

São trazidos alguns dos principais desafios relacionados ao tema: o colonialismo biocultural, a biopirataria, a necessidade de maior cooperação internacional para garantir o respeito às detentoras dos conhecimentos tradicionais e aos países subdesenvolvidos, e a necessidade de um olhar multidisciplinar sobre o assunto.
