This monograph is the result of the analysis of the phenomenon of judicial activism in Brazil, from the perspective, after analysis and bibliographic research, of the principle of separation of powers, provided for in art. 2 of the Brazilian Federal Constitution, which enshrined the theory of tripartite powers enunciated by Montesquieu. After an introduction, which addresses the three powers, Legislative, Executive and Judiciary, and identifies their typical and atypical functions, this monograph enters the judicial activism, exploring its concept, its relation to the growth of judicialization in the country, as well as its presence and approach in Brazil. Having made these considerations, the course completion work dissects about judicial activism in a critical way, pointing performances of the Judiciary that end up extrapolating the limit of its functions and entering into issues and matters of competence of the other powers
