This paper, obviously focused in Labour Procedure, has as its main purpose the approach of the effects of the Preliminary Injunction in two distinctive moments, being the first prior to the res judicata and the second after the res judicata. For the first it will be analyzed “The effects of the Preliminary Injunction when the claim is deemed groundless”, namely, the keeping or not of the referred relief pending Appeal. For the second, it will be analyzed the “Responsibility of the beneficiary of the Preliminary Injunction when the claim is deemed groundless”, namely, the responsibility over the repair of damages eventually caused to the party, who, by reason of the granting of the Preliminary Injunction, had to bear it at that procedural timing
