This monograph was prepared in order to make an analysis on the succumbent attorney fees that were institutionalized with the promulgation of Law 13.327/16 - known as the Labor Reform. By means of a bibliographic research this work intends to approach it’s etymology and evolution from the first signs of its existence until our legal system. After analyzing the origin of the institute of succumbent attorney fees, through bibliographic studies and jurisprudence, an analysis is made of the devices introduced by the Labor Reform and the impact generated by it’s interpretation regarding it’s constitutional validity. Such a matter is far from being pacified. ADI nº 5.766, since it’s filing, has not yet been judged by the Superior Federal Court. Although Superior Courts tend towards the constitutionality of the provision, we note that Regional Courts have different positions and make it clear that this law violates constitutional principles. Thus, this work defends the unconstitutionality of the condemnation of the succumbent attorney fees in the Labor Court
