This study aims at a comparative analysis between the governing power of the employer and the rights and guarantees of the employee, being presented their concepts, historical evolution and its application in the Brazilian legal and justice system, for better understanding of the subject. It will also address the issue from the perspective of the conflict of the governing power of the employer, that arises from property law, and the right to employee's privacy, as well as the inviolability of the secrecy of correspondence, telegraphic, data and telephone calls and also human dignity. The question about the abuse of the governing power, which may cause the configuration of moral harassment, will also be studied. There will also be analyzed the ways to mitigate these conflicts, finalizing the analysis with different positions of the Brazilian courts on the subject in an attempt to trace a pattern on the boundaries of the governing power of the employer
