Resumo: This thesis will discuss about the Phased Real Estate Incorporation against the interest of the Developer to always meet the demand of the consumer market, regardless of the Real Estate development, “product”, originally described in the incorporation memorial. Therefore, the form of phases project changes that are not still sold to the public of large Real Estate projects, will be treated, without prejudice to the rights of the purchasers of the previous phases, changes to the ideal fraction of the independent units against the legal text and its requirements, attribution of the real fraction of land from the units by a non-mathematic criterion in accordance with a fictitious ground projection, changes to the ideal fraction of the units which have already been sold and the current reflections caused to the developers by the interpretation of the registers about the possibility and the form of implementation of the Phased Real State Incorporation
