Abordagem sobre o trabalho escravo contemporâneo: meios de coerção

This work aims to provide a brief contextualization regarding labor performed under degrading conditions which configures the violation of various constitutional rights, in particular the one referring to human dignity, and described as labor akin to forced labor, referred to as modern-day slavery in article 149 of Criminal Law. Research data over the doctrine and in specialized articles showed that despite being denied by some, slave-type labor exists all over our country’s territory, chiefly in the most deprived regions which tend to be in the rural area. Data also identified the key instruments to fight modern-day slavery labor, mainly the firm intervention carried by the Labor Department that has provided means to abolish this type of social injustice which taints our society and negatively reflects on both the country’s social and economic progress and on its image for international agencies. Conclusions suggest that a lot has been done to solve this issue. However, given the defiant attitude displayed by some obstinate employers who continue to commit the crime described in article 149 of the Criminal Law, it is imperative that the law be updated with more efficient mechanisms so as to recover the dignity of workers subjected to modern-day slavery conditions
