Studies the existing problem of the refusal of the necessary joinder of plaintiff to join the lawsuit as a plaintiff. Investigating the joinder, with the analysis of its concept and classifications, provides a broad notion of the institute. Lists the types of necessary joinder of parties, illustrating with situations described in the law and coming from the substantive law. Under the applicable constitutional principles, analyzes the different understandings on the matter. Debates the issue of the renitent necessary joinder of plaintiff. Suggests the atypical summoning as a way to resolve the issue without offending the principles of the free access to the justice and freedom. Analyze the matter in accordance with the new Code of Civil Procedure
