In this paper we discussed the responsibility of the State in outsourcing, being of paramount importance to delve into the concepts of civic duties, their sorts and consequences. It also deals with the civic duties of the State itself since it is the subject with more specificity. Secondly, we discussed outsourcing and its origin, evolution and consequences in businesses and labor, as well as its introduction into the sphere of public administration, which ultimately reflected on the theme of this thesis, namely State responsibility in outsourcing. At another point, we presented doctrine and jurisprudence discussions, legislative gaps and proposals, including very recent decisions. We also included and analysed a bill in progress, related to the subject, not in order to exhaust the discussion, but to arouse the desire to reflect on the need for change of thought when it comes to the labor rights guarantees of the outsourced worker
