As Nações Unidas e o estado de direito em Timor-Leste

Resumo: Build and strengthen the rule of law in developing countries, particularly those that are in transition or emerging from a period of armed conflict, has become the central focus of the work of the United Nations (UN). Although locally rule of law activities are widely supported by the UN, the concept is not yet understood or effectively implemented. It can be argued that the donor community puts too much emphasis on reform of formal and centralized institutions that do not necessarily reach the entire population. This is the case of Timor-Leste, where the imposition by the UN's model on rule of law through its missions has been, in certain circumstances, neglecting local values, the role of custom and informal legal systems. In this context, this chapter analyzes the justice sector in Timor-Leste andanswers the following questions: To what extent the rule of law programs of the United Nations have contributed to a better justice in Timor-Leste? What are the main difficulties in its implementation? Is there a positive evolution of the rule of law in Timor-Leste? It is argued that the absence of a responsible justice sector in Timor-Leste has the potential to increase instability in the country. We consider responsible justice the one that is exercised by competent representatives in accordance with established law and in a completely independent way from executive power.
