Resumo: This article aims to analyse the rights’ derogation clauses foreseen in the International Covenant on Civil and Political Rights and the European Convention on Human Rights. The several conditions that a State must fulfil to legitimately derogate from its obligations under these instruments in times of crisis will be studied and problematized, considering the existent jurisprudence. Finally, the problem of consequential derogations will be discussed, bearing in mind the experience of human rights’ suspensions during the 2020 pandemic crisis.
