A CRITICAL VIEW THROUGH COMPARATIVE LAWSuccessãoCapacidade SucessóriaIndignidadeTaxatividadeViolência DomésticaSuccessionSuccession capacityIndignityTaxationDomestic violenceDissertação de Mestrado em Ciências Jurídico-Forenses apresentada à Faculdade de DireitoO presente trabalho versa sobre a iminente necessidade de ampliar o diminuto leque de causas de incapacidade por indignidade sucessória prevista pelo ordenamento jurídico português, em especial a integração do crime de violência doméstica.Num primeiro momento, é feita uma análise sobre a capacidade sucessória. Posteriormente, é elaborada uma breve exposição acerca do instituto da incapacidade por indignidade, tanto sob um ponto de vista histórico-material, como jurídico-social, retratando de seguida, o leque de causas de indignidade contempladas no nosso Código Civil, concretamente no Art. 2034.º do Código Civil, de forma pormenorizada. Efetuada a análise suprarreferida, confrontamo-nos com uma necessidade de reordenação de prioridades ético-sociais que se refletem, quer ao nível da gravidade, quer ao nível da finalidade imposta a uma determinada conduta, num aditamento ao conjunto destas causas, de forma a integrar o crime de violência doméstica.O referido aditamento, deve-se, essencialmente, ao facto do regime da incapacidade por indignidade sucessória se qualificar pelo seu caráter taxativo, ou seja, apenas são previstas como causas de indignidade sucessória as que se encontram no Art. 2034.º do C.Civ..De modo a irmos ao encontro do tema eleito, foi fulcral a análise do crime de violência doméstica, quanto ao seu nível de gravidade jurídico e social, à sua finalidade, de acordo com os critérios civis, penais e constitucionais exigidos e à efetiva proposta de aditamento deste crime, enquanto causa de incapacidade por de indignidade.Por fim, tecemos comparações com outros ordenamentos jurídicos onde é reconhecido ou não o crime de violência doméstica entre outras causas, além das previstas pelo nosso ordenamento jurídico português.This dissertation addresses the imminent need to complete and broaden the limited range of causes of debarment from succession provided by the Portuguese legal system, especially the integration of the crime of domestic violence.In the first moment, an analysis is made on the capacity of succession.
