A primeira pode ser de simples apreciação, de condenação ou constitutiva. São aquelas em que o autor pretende que o tribunal declare a existência ou inexistência de um direito ou de um facto, que condene o réu na prestação de uma coisa ou de um facto ou autorize uma mudança na ordem jurídica existente. A segunda tem por finalidade a reparação efetiva do direito violado, não visando declarar direitos pré-existentes, mas sim providenciar a realização coativa de uma prestação devida. O mesmo é dizer que as ações executivas, partindo de um direito reconhecido num título executivo, destinam-se a permitir o cumprimento coercivo da obrigação, através do poder de autoridade do Estado . Se no campo da ação declarativa têm surgido algumas inovações significativas, já no campo da ação executiva, são raríssimas. Daqui decorre a importância de estudar esta matéria, no sentido de perceber até que ponto o nosso legislador vai, no âmbito das questões de que esta dissertação se ocupa, nomeadamente a questão da natureza jurídica da venda, os casos em que a venda é nula, através da análise da legislação em vigor, em especial o art.º 838.º do NCPC. Procede-se também à análise da venda de coisa alheia e ainda à análise da falta ou nulidade de citação do executado para o processo.Este estudo contempla essencialmente o ordenamento jurídico Português, através da análise de legislação, doutrina e jurisprudência.In civil procedural law, there are two kinds of actions, the declaratory action and the executive action. The first can be of simple appreciation, condemnation or constitutive. These are those in which the author intends the court to declare the existence or nonexistence of a right or a fact in order to condemn the defendant in the provision of a thing or a fact or authorize a change in the existing legal order. The second one has the purpose tto effective redress of the violated right, not aiming to declare pre-existing rights, but providing the coercive realization of a due benefit. The same is to say that executive actions, based on a right recognized in an enforcement order are designed to allow the coercive fulfillment of the obligation through the authority of the State. If in the field of declarative action some significant innovations have arisen in the field of executive action, they are very rare. Hence the importance of studying this matter, in order to understand to what extent our legislator goes in the scope of the issues that this dissertation is dealing with, namely those of legal nature of the sale and the cases in which the sale is null. Through the analysis of the legislation in force, especially the article 838 of the NCPC. It is also analyzed the sale of another thing and also the analysis of the lack or nullity of citation of the executed in the process.
