Existem persistentes dúvidas na doutrina quanto ao enquadramento e qualificação da área do direito financeiro público. Por um lado, existe a discussão doutrinal referente à natureza jurídica da responsabilidade reintegratória, discutindo-se se esta será uma responsabilidade do ramo do direito civil. Mas esta não é a questão a que nos propomos dar resposta. Por outro lado, elegemos como ponto central desta dissertação a reflexão em torno do enquadramento da responsabilidade financeira sancionatória num dos vários ramos do direito: Será uma responsabilidade penal? Uma responsabilidade administrativa? Contraordenacional? Disciplinar? Ou poderá considerar-se um ramo do direito autónomo?Diferentemente do que sucede com a responsabilidade financeira reintegratória, a responsabilidade financeira sancionatória caracteriza-se pela aplicação de uma sanção, sendo ela a multa, com o objetivo de sancionar os sujeitos que pratiquem os ilícitos tipificados na LOPTC como tal. Da mesma forma, o direito administrativo sancionador tem como objetivo sancionar condutas ilícitas.A responsabilidade financeira sancionatória deve ser enquadrada, como melhor explicaremos em seguida, num ramo autónomo do direito sancionador, ainda que inserido no vasto universo que é o direito administrativo sancionador.In Portugal, the financial accountability regime is divided into two types, namely, “sanctionatory financial accountability” (responsabilidade financeira sancionatória) and “reinstatement financial accountability” (responsabilidade financeira reintegratória). There are continuing doubts in the legal theory regarding the framing and qualification of the public financial law field. On the one hand, there is a discussion between legal writers regarding reinstatement accountability - is this a responsability that belongs to the civil law branch? However, this is not the question we are going to be answering. On the other hand, we have the core question of this dissertation - in what branch of law is sanctionatory financial accountability included? Is it considered to be a criminal responsability? An administrative one? A responsability under administrative offences? A disciplinary one? Or can it be considered an autonomous law branch?Unlike what occurs with the reinstatement acoountability, the sancionatory financial accountability is characterized by the application of a sanction, which is the fine, with the intent of sanctioning the person who practices the financial infraction typified in the LOPTC as such.
