Paradoxalmente, as famílias monoparentais são representadas, quase que com exclusividade, por mulheres que vivem sós com seus filhos menores. Historicamente, por força de um sistema patriarcalista, o desempenho da função de cuidado (cerne da relação pais e filhos) estava a cargo, exclusivamente, da mãe. Contudo, em decorrência, sobretudo, da consagração do princípio da igualdade entre os cônjuges, é preciso que o dever de cuidado para com os filhos menores pertença, igualmente, a ambos os pais e possa ser atribuída a tal função de cuidado uma significação econômica, social e política de relevo, uma vez que disso depende a renovação saudável da humanidade. Na abordagem da origem e evolução histórica da família, com olhos voltados à sua constituição e estrutura, somos levados a investigar o direito que toca diretamente tal instituição, qual seja, o direito de constituição de família, enfrentando, inclusive, seu meio “preferencial” de constituição (o casamento) e a consequente filiação. Constatando, dentre outras, a diminuição dos núcleos familiares e de suas atribuições inalienáveis, a filiação como centro da sociedade familiar, a igualdade entre os genitores no desempenho das responsabilidades parentais e a existência de um dever jurídico de cuidado de ambos em relação aos filhos menores. Associando tais ideias com as noções gerais de responsabilidade civil, após o exame de sua evolução dogmática e sua relação (passada e presente) com o Direito da Família, somos levados, então, à análise dos requisitos genéricos da responsabilidade civil extracontratual por ato ilícito e o preenchimento de cada um deles nos casos de abandono afetivo nas relações entre pais e filhos. Sendo apurado, por fim, o dano existencial configurado em tais situações, para assim, concluirmos acerca da aplicabilidade do instituto da responsabilidade civil extracontratual por fato ilícito nos casos de abandono afetivo paterno-filial.The family, within a hierarchy of values, for the vast majority of people, is at the apex. Paradoxically, single-parent families are represented, almost exclusively, by women living alone with their minor children. Historically, by virtue of a patriarchal system, the performance of the care function (the core of the parent-child relationship) was exclusively for mothers domain. However, as a consequence, above all, of the principle of equality between the spouses, it is necessary that the duty of care for the minor children belongs equally to both parents and can be attributed to the care function an economic, social and political importance, since that depends on the healthy renewal of humanity. Approaching the origin and historical evolution of the family, with a view to its constitution and structure, we are led to investigate the right that touches directly that institution, the right to establish a family, even facing its “preferred” way of constitution (the marriage) and the consequent affiliation. It has been noticed, among others, the reduction of family nuclei and their inalienable attributions, affiliation as the center of family, equality between parents in parental responsibilities and the existence of a legal duty to care that belongs to both in relation to children. Associating these ideas with the general notions of civil liability, after examining their dogmatic evolution and their relation (past and present) with the Family Law, we are then taken to the analysis of the generic requirements of a non-contractual civil liability for an unlawful act and the fulfillment of each of them in cases of affective abandonment in the relationship between parents and children.
