Tendo em consideração a evolução histórica da posição do animal, influenciada pelos valores de proteção e cuidado com estes seres vivos, observamos uma tendência para a alteração da sua posição jurídica. Nas páginas que se seguem, vamos analisar se a superação dos animais quanto às coisas, proposta pela lei e, ponderando o bem-estar dos não humanos, é ou não, a melhor solução. Percorrido este caminho, que não é livre de críticas e discussão, sobressai a questão mais importante, isto é: a de defender os animais, independentemente do estatuto que a lei lhes confere.
