O fenómeno do tráfico de seres humanos não pode ser ignorado nem esquecido, porque convivemos com ele mesmo sem sabermos.O TSH, nasce da lei da oferta e da procura, do lado da oferta pessoas que sofrem de grande carência económica e dificuldades sociais (as vítimas), e do lado da procura, os traficantes que agem de forma organizada , que detêm melhor estatuto económico que as vítimas e as reduzem a objetos geradores de lucro, “a mercadoria humana” . Com esta temática do regime jurídico do TSH nos PALOP e em Portugal pretendo demonstrar a dificuldade que ainda existe em África de se tratar de temas como este, sendo quase como um tabú. Encontrei dificuldades de toda a ordem, desde falta de informações e acesso a dados relacionados com o tema, até uma certa inérica por parte de alguns órgãos de justiça penal que contactei a fim de me fornecerem informações nos vários países do PALOP. Existe ainda um longo caminho a ser percorrido e somente com esforço e cooperação jurídica de todos os Esstados dos PALOP, poderá fazer-se frente a este gigante que teima em expandir-se no Mundo e mais em especial em África, devido às imensas necessidades, falta de informação e justiça efetiva, quer seja por falta de vontade dos decisores políticos, quer seja por constantes instabilidades e convulsões a todos os níveis.A growing sense of globalization has forcefully brought an open market and easy internet acess which in turn facilitated transnacional organized crime and human trafficking on top of the list. The phenomenon cannot be forgotten neither ignored because it happens every day under our watch. Its origin may have come from the law of “give and take”. From the give side, we have the economically poor and socially marginalised (victims) and from the take side, we see those that do organized trafficking have more economical power and use victims as human “goods” for their ultimate profits. I wish to demonstrate in my short presentation what could be some serious research and investigating challenges, judiciary mishandled cases and how decisions are taken within Portuguese Speaking Oficial Language countries to stop this unspeakable practice. In my research within various PSOL’s countries, I encountered many obstacles; from information censorship to being a threat to reveal serious justice secrets.I believe, we still have a long way to go but with candid efforts and meaningful cooperation with local authorities from all PALOP’s countries, we will be able to say now we are on the way to tackle this expanding giant that is inbeded in África and around the world due to extreme poverty conditions, lack of information and active justice, corrupt polices and politicians, constant national instabilities and all kinds of convulsions. The legal Framework for tracking in human beings in the portuguese speaking countries and Portugal is an advantage aproach of the importance that the prevention and protection of victms have in this century.
