spelling A Ação de Reconhecimento da Existência de Contrato de Trabalho e a Presunção Laboral na Era DigitalThe Action to Acknowledge the Existence of an Employment Contract and the Labor Presumption in the Digital AgeTrabalhadorTeletrabalhoDignidadeProvaPresunçãoWorkerTeleworkingDignityProofPresumptionDissertação de Mestrado em Direito apresentada à Faculdade de DireitoWith this study we propose to reflect on the Action to Acknowledge the Existence of an Employment Contract (ARECT) in the Digital Age and, above all, about the problems that it poses at the level of evidence within the scope of the job presumption provided for in article 12 of the Labor Code .ARECT appears to be a special labor action that aims to qualify a certain contractual relationship as an employment contract, checking certain signs of labor and that presents its own procedure, since it consists of two phases: administrative and judicial. However, the Law is not clear and there are several doubts that arise in the course of it, starting with the procedural statute that each of the intervening parties in the action holds, passing through the terminology used and ending in the limits that the effects of the same present .On the other hand, it is not new that Telework has gained greater application, publicity and “popularity” within the more legal conservative community. In this light, some companies have started to introduce such a special contractual modality as a rule in new hires and others have completely remodeled their labor relations creating a kind of mixed regime (in person and at a distance).In this way, the controversies that have always arisen in the face of the traditional labor provision regime also arise, now, in relation to this modality. Nevertheless, times have changed, but the worker's weapons (the most fragile contractual part) have remained be the same.Finally, alongside the procedure itself, we will seek to analyze whether the presumption of work referred to above is prepared and able to face these new problems and contractual atypicalities or if, on the contrary, it is completely devitalized and, therefore, radiates a need for intervention the legislator in this matter (albeit due to the acceleration that the pandemic COVID-19 represented in these matters). To that extent, does it make sense to start thinking about creating a [new] presumption of Telesubordination? We will see.Com este estudo propomo-nos refletir acerca da Ação de Reconhecimento da Existência de Contrato de Trabalho (ARECT) na Era Digital e, sobretudo, sobre os problemas que esta coloca ao nível da prova no âmbito da presunção laboral prevista no artigo 12.º do Código do Trabalho.A ARECT afigura-se uma ação laboral especial que visa qualificar determinada relação contratual como contrato de trabalho verificados certos indícios de laboralidade e que apresenta uma tramitação própria, desde logo, porque é constituída por duas fases: a administrativa e a judicial. No entanto, a Lei não é clara e várias são as dúvidas que surgem no decorrer da mesma, a começar pelo estatuto processual que cada um dos intervenientes na ação é titular, passando pela terminologia utilizada e a acabar nos limites que os efeitos da mesma apresentam.Por outro lado, não é novidade de que o Teletrabalho ganhou maior aplicação, publicidade e “popularidade” no seio da comunidade jurídica mais conservadora. Nesta ótica, algumas empresas começaram a introduzir tal modalidade contratual especial enquanto regra nas novas contratações e, outras, remodelaram por completo as suas relações laborais criando uma espécie de regime misto (presencial e à distância).Deste modo, as controvérsias que sempre se colocaram face ao regime de prestação laboral tradicional surgem também, agora, relativamente a esta modalidade. Não obstante, os tempos mudaram, mas as armas do trabalhador (parte contratual mais frágil) continuaram a ser as mesmas.Por fim, a par da tramitação propriamente dita, procuraremos analisar se a presunção laboral referida anteriormente se encontra preparada e apta para enfrentar estes novos problemas e atipicidades contratuais ou se, pelo contrário, se assume completamente desvitalizada e, portanto, irradia uma necessidade de intervenção do legislador nesta matéria (ainda que muito por força do acelerador que a pandemia COVID-19 representou nestas questões). Nesta medida, será que faz sentido começarmos a pensar na criação de uma [nova] presunção de Telessubordinação?
