The present dissertation is derived from an in-depth research on two institutes: the resolution for the benefit of the insolvent estate and the Paulian objection. First, a general introduction is made, which will later lead us to an in-depth and individualized analysis of the institute of resolution for the benefit of the insolvent estate and, second, of the Paulian objection. Finally, in the central chapter of the dissertation, all the spectrums of doctrinal and jurisprudential understandings are explained. The purpose of the research was to deepen the relationship between these figures in the context of insolvency, what are their requirements, purposes, and consequences for creditors. The overview of the various positions and understandings allows for a critical analysis of the legislative option contained in article 127 no. 3 of the Portuguese Insolvency and Corporate Reorganization Code, the central rule of this dissertation.
