Neste estudo é nossa intenção analisar e perceber de que forma a justiça portuguesa responde, de facto, às necessidades e expectativas das vítimas de violência doméstica, acedendo para tal aos significados e representações que estas constroem sobre o sistema de justiça criminal. O estudo, caracteriza-se pela existência de uma amostra de conveniência do sexo feminino, composta por grupos contrastantes, atendendo a diversas variáveis (e.g., parentalidade; fase do processo judicial; contexto de acolhimento). Para tal desenvolveu-se uma entrevista semiestruturada, como forma de aceder, através das suas narrativas, aos significados e representações de 12 mulheres vítimas de violência na intimidade, que solicitaram diferentes apoios como forma de inverter e quebrar o ciclo da violência. As participantes do estudo beneficiavam, aquando realização das entrevistas (que foram gravadas em suporte áudio para posterior análise categorial dos dados obtidos), de diferentes suportes: Emergência Social (LNES 144); Apoio/Acompanhamento (CAVV) e Acolhimento Institucional para proteção e segurança (Casa de Abrigo). Após processo de análise categorial dos dados obtidos nas entrevistas, verificamos que existem variações nestas representações, de acordo com os grupos amostrais:-mulheres sem filhos tendem a representar de forma negativa a justiça, não se encontrando qualquer padrão específico entre a construção das representações com o contexto em que as vítimas se encontravam, depreendendo-se por isso que não é o contexto ou o suporte de maior ou menor segurança que condiciona as representações. Já no que respeita ao contato com o sistema de justiça e a fase do processo influenciam essas representações, isto é os relatos desfavoráveis dizem respeito a mulheres vítimas cujo o contato com a justiça já é recorrente, sendo que a maioria delas já tiveram contato com instancias superiores (e.g. fase de inquérito pelo Ministério Público, julgamento, sentenças, suspensões provisórias do processo com ou sem injunções. Constatamos que as representações que as mulheres vítimas de violência doméstica constroem do enquadramento jurídico-penal português se situam num patamar negativo, centradas na ideia de que é ineficaz, no caráter vitimizador dos procedimentos formais, mas sobretudo no constructo de impunidade do ofensor e penalização da vítima. Considera-se que os dados obtidos vão apoiar uma reflexão fundamentada sobre o modelo de funcionamento do sistema de justiça criminal português no que respeita à intervenção instituída para o problema da violência doméstica, de modo repensar-se as bases para a implementação de um novo paradigma. Gradually, and in different settings, the phenomenon of domestic violence has been an object of interest, both legally, by assisting since 2007, to the criminalization of all kinds of violence in the private sphere, and socially, by imposing an adjustment of policy intervention. In this study we aim to analyze and understand how the Portuguese justice responds, in fact, to the needs and expectations of victims of domestic violence, accessing to the meanings and representations that they raise on the criminal justice system. The study is characterized by the existence of a convenience female, comprising contrasting groups, serving different variables (eg, parenting, stage of legal proceedings; host environment). To this end a semi-structured interview has been developed, as a way to access, through their narratives, to the meanings and representations of 12 female victims of intimate violence, who other than that requested support as a way to reverse and break the cycle of violence. The study participants benefited, during the interviews (which will be recorded on audio support for analysis of categorical data), different responses: Social Emergency (LNES 144); Support / Monitoring (CAVV) and Institutional Shelter for safety and security (Shelter). After the process of categorical analysis of the data obtained in the interviews, we found that there are variations in these depictions, according to the sample groups: childless women tend to negatively represent justice, not finding any specific pattern between the construction of representations and the context in which the victims were, assuming therefore that is not the background or support of greater or lesser security which determines the representations. However, with respect to the contact with the justice system and the stage of the process there is a direct influence on these representations, ie, unfavorable reports relate to women victims whose contact with the justice system is already relapsed, and most of them already had contact with higher instances (eg Survey by the Public Ministry, judgments, sentences, provisional suspensions of the process with or without injunctions). We notice that the representations that women victims of domestic violence build of the legal criminal Portuguese framework is at a negative level, focusing on the idea that it is ineffective, on the victimizer character of formal procedures, but especially in the construct of impunity of the offender and punishment of the victim.
