During this period, i was able to verify a greater tendency to commit crimes of patrimonial nature. On a smaller scale and without any reference to statistics to this effect, it was also posible to conclude to the propensity to commit crimes against the sexual freedom and self-determination of the victims. Regarding crimes of a sexual nature, it is confirmed that they occur considerably more frequently - as a general rule - when the victim is a minor or someone mentally handicapped. It should also be noted that the tendency to commit crimes against property is more concentrated in the city of Portalegre and that, on the contrary, the tendency to commit crimes against sexual freedom and self-determination increases in parishes like Avis and Fronteira. A different question, but one that will always be related to the above, as it will be explained further. It is up to the court of the last conviction to, ab initio, carry out the legal accumulation of all sentences that may be accumulated, even if the same sentences have been accumulated in other proceedings. By imposing a new trial on the court of last conviction, the legislator intended precisely that it should be so, since it is the last to intervene and, consequently, has the most detailed information. Thus, considering the reasons related to the attribution of territorial jurisdiction to the court of the last conviction to judge the accumulation of sentences, it will only be possible to disregard such imposition for reasons of material jurisdiction, which will occur whenever the defendant has been previously convicted of a sentence that exceeds five years of imprisonment. In this case, the competency to judge the accumulation of sentences will belong to the Collective Court. For this reason, my intention is to summarize, in a certain way, the process of a case subject to accumulation in order to facilitate the understanding of it, basing myself, for this purpose, on the analysis of several cases that I followed during the internship.O relatório aqui apresentado constitui o reflexo de quatro meses de estágio que realizei no Juízo Central Cível e Criminal de Portalegre. No referido período, foi possível averiguar uma maior tendência para a prática de crimes de natureza patrimonial. Em menor proporção e sem qualquer referência a estatísticas para o efeito, é ainda possível concluir pela propensão para a prática de crimes que atentam contra a liberdade e autodeterminação sexual das vítimas. Atendendo aos crimes de natureza sexual, confirma-se ocorrer com uma assiduidade consideravelmente mais elevada - regra geral- sempre que a vítima seja menor ou portadora de anomalia psíquica. De referir será ainda que a tendência para a prática dos crimes de natureza patrimonial apresenta maior concentração na cidade de Portalegre e que, a contrario, a tendência para a prática dos crimes contra a liberdade e autodeterminação sexual aumenta em Freguesias como Avis e Fronteira. Diferente questão mas que terá sempre, naturalmente, relação com o acima exposto, como adiante melhor se concretizará, será a que trata do cúmulo das penas. É ao tribunal da última condenação que cabe, ab initio, efetuar o cúmulo jurídico de todas as penas cumuláveis. Ao impor a realização de um novo julgamento ao tribunal da última condenação, o legislador pretendeu assim fosse, por ser o último a intervir no tempo das condenações, dispondo dos elementos com maior detalhe e pormenor. Assim, considerando os fundamentos atinentes à atribuição de competência territorial ao tribunal da última condenação para julgar o cúmulo das penas, só será possível desconsiderar tal imposição por motivos de competência material, que ocorrerá sempre que o arguido tenha sido anteriormente condenado numa pena que, somada à do tribunal singular, exceda os cinco anos de prisão. Nesse caso, a competência para julgar o cúmulo passará a pertencer ao Tribunal Coletivo.
