Vamos falar da criação deste instituto, tentar perceber o porquê da sua criação, que respostas procurava dar, e se conseguiu de alguma forma aí chegar. Vai analisar-se o ambiente em que se insere, assim como as especificidades e particularidades levam a que esta figura seja tão utilizada no tráfego jurídico.Será exposto o seu regime, assim como o da fiança civil, contrapondo os dois. Serão ainda enunciadas as particularidades da fiança omnibus, resultado das especificidades da sua envolvência.A fiança omnibus uma figura envolta em controvérsia desde o seu começo, e, portanto, desde essa altura que a Jurisprudência como a doutrina tentam procurar respostas para a sua determinação e a sua consequente validade.Mas apesar de ser debatida há muito tempo, ainda hoje é uma questão bastante actual e intensa, devido à sua extrema utilidade, mas igualmente pelas adversidades que pode gerar, tanto para as partes, como para a própria relação fidejussória estabelecida, devido à sua estrutura.Serão analisados os critérios de interpretação relativos à busca pela determinação / determinabilidade do objecto da fiança omnibus, assim como elencados uma série de regras e deveres pelos quais as partes se devem reger, mas também será realizada a exposição dos princípios e preceitos normativos que vão reger a relação estabelecida.Será versado também questões relativas a preceitos normativos, pelos quais poderão ou deverão ser utilizados para apreciar da validade da fiança omnibus.Serão igualmente, colocadas algumas questões, quanto à análise de situações específicas de problemas que não são passíveis de resolução linear e uniforme.Irá proceder-se também ao elenco de algumas regras e deveres, assim como princípios norteadores, que as partes deverão observar, na prática da utilização desta figura, relativamente às relações estabelecidas entre elas.The following work will deal with the subject of warrant omnibus, more specifically on the question of the determination or determinability of its object, so that it can be ascertained by its validity.To this end, an exhibition on the creation of this institute, on which it was based and what solutions it created, will be provided. We will talk about the creation of this institute, try to understand the reason for its creation, what answers it tried to give, and if somehow it got there. It will be analysed the environment in which it is inserted, just as the specificities and particularities lead to this figure being so used in legal traffic.It will expose its regime, as well as the civil bond, opposing the two.
