Desenvolvida com uma interpretação da História do Direito, a dissertação esta dividida em três partes essenciais, o primeiro momento abarca a explicação metodológica acerca de conceitos e ideias centrais para o desenvolvimento da pesquisa, como o conceito e a ideia de democracia e autoritarismo. O segundo momento será de uma retomada histórica com a finalidade de exposição sobre as ideias republicanas e o contexto que emergiram e foram difundidos na Primeira e Segunda República e posteriormente como este mesmos ideais foram colocados em questionamento por intelectuais, com o “fracasso” do regime republicano, os projetos políticos desenvolvidos no período que antecederam o Estado Novo e o governo de Getúlio Vargas, em específico a ideia do Estado Corporativo Autoritário de Oliveira Vianna, a sua leitura sobre a democracia autoritária e a possibilidade de um movimento cíclico de revisitação de ideias e conceitos influenciado pelo desenvolvimento social. Sua crítica a cópia de instituições estrangeiras, seus estudos das gentes brasileiras, sua delimitação para forma um perfil sociológico, antropológico e geográfico capaz de refletir a “desorganização profunda” que se passava elevou seus trabalhos e sua pessoa a intérprete do Brasil, e intelectual estudado até nossos dias para a compreensão deste cenário histórico. A pesquisa conclui-se no fim,alcançando o pretendido, a criação de um arcabouço intelectual tão vívido em nossa sociedade que cria essa marca de re-conceito e reinterpretações em concepções determinantes para a vigência de uma democracia, nos fomenta a escrever sobre este autor que foi capaz de muito para provar suas percepções e ideais.This work aims to analyze the development of authoritarian legal thought in the historical period of 1930-1940 and how the ideas developed by authoritarian authors influenced the evolution of authoritarian theories and practices, influencing authoritarian and dictatorial regimes. Developed with an interpretation of the History of Law, the dissertation is divided into three essential parts, the first moment covers the methodological explanation about concepts and ideas central to the development of the research, such as the concept and idea of democracy and authoritarianism. The second moment will be a historical resumption with the purpose of exposing the republican ideas and the context that emerged and were disseminated in the First and Second Republic and later on how these same ideals were put into question by intellectuals, with the "failure" of the regime. republican, the political projects developed in the period that preceded the Estado Novo and the government of Getulio Vargas, in the particular Oliveira Vianna's ideas about the corporate and authoritarian state, his reading of authoritarian democracy and the possibility of a cyclical movement of revisiting ideas and concepts influenced by social developmentHis criticism of copying foreign institutions, his studies of Brazilian people, his delimitation to form a sociological, anthropological and geographic profile capable of reflecting the “deep disorganization” that was going on, elevated his work and his person to an interpreter of Brazil, and a studied intellectual. to our days for the understanding of this historical scenario.
